Terms and Conditions

§ 1 Scope

These General Terms and Conditions (GTC) apply to all contracts concluded between Sima Couture – Silva Erkoc, Beekstr. 33, 47051 Duisburg, Germany
and customers in our physical store. Different terms of the customer shall not apply unless we expressly agree in writing.

§ 2 Conclusion of Contract

The purchase contract is concluded upon agreement on the purchase price and handover or ordering of the goods.

§ 3 Prices and Payment

1. All prices are final prices and include statutory VAT.

2. Payment is due immediately and can be made in cash, by card, or via other payment methods offered in the store.

§ 4 Retention of Title

Goods remain our property until full payment has been made.

§ 5 Delivery Time & Possible Delays

Our standard delivery times are based on usual logistics processes. Please note that customs clearance or logistical circumstances (e.g. international deliveries, custom-made items, unexpected supply chain events) may cause delays of up to 10 working days.

§ 6 Alterations & Additional Requests

1. Alterations to dresses are only possible upon prior agreement and must be recorded in writing in the order.

2. Additional requests – such as shortening the train, adding sleeves, or a custom veil – are not included in the purchase price and will be charged separately.

3. Extensive alterations require additional time and should be planned well in advance.

§ 7 Fittings & Appointments

1. Fitting appointments are scheduled individually and within a reasonable time after the dress has arrived.

2. For custom-made items, a second fitting may be necessary, especially in case of complex adjustments for a perfect fit.

§ 8 Cancellation & Withdrawal

1. There is no statutory right of withdrawal for purchases made in our store.

2. As a gesture of goodwill, we grant the following cancellation policy:

  • Cancellation up to the 3rd calendar day after order placement: 30% cancellation fee.
     
  • From the 4th calendar day onwards: No cancellation possible. In this case, we reserve the right to retain the deposit or – if payment is still outstanding – to claim the remaining balance.

3. Cancellations must be submitted in writing (by email or letter) and are only effective once confirmed by us in writing.

4. Verbal or telephone cancellations are not sufficient.

§ 9 Collection

Please note that we do not schedule pick-up appointments on Saturdays due to high customer demand. We kindly ask you to plan your collection on weekdays.

§ 10 Warranty

Statutory warranty rights apply.

§ 11 Liability

1. We are fully liable for damages caused intentionally or by gross negligence.

2. In the case of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations).

3. Liability for damages resulting from injury to life, body, or health remains unaffected.
